On January1, 2022, the decree making Qualiopi certification mandatory in order to benefit from public or mutualized funds came into force. In theory, all training organizations, CFAs and skills assessment or VAE centers that have not yet obtained certification should no longer have access to it. However, the decree of December 28, 2021 clarifies the situation. Certain training organizations may continue to have access to it, under certain conditions.
We’d like to take a look at some of the possible scenarios.

Reminder: What is Qualiopi?
Following the 2018 Avenir Law, the state has created a quality certification, named Qualiopi. This certification attests to the quality of the process implemented by the organization that holds it.
Since January1, 2022, this certification has been compulsory for any organization wishing to access public and mutualized funds, such as financing by OPCOs, Pôle Emploi, etc.
It is issued by certification bodies accredited or authorized by Cofrac.
Certification is based on seven criteria, which assess the quality of the services delivered and the processes implemented by training organizations. To obtain certification, you must have no major non-conformities. The criteria, and the indicators that make them up, are available in the national quality reference guide.
You’ll need to familiarize yourself with the standards, comply with the criteria, and then sign a contract with a certification body to obtain an initial audit date. At the end of the audit, you either receive your certification, or your auditor tells you what you need to work on within three months in order to obtain it.
Although the deadline for Qualiopi certification was set for January1, 2022, there are still many training organizations that have not yet obtained certification.
You obtained Qualiopi in 201
If you have already obtained Qualiopi certification, you will continue to benefit from public and mutualized funds, with no further steps to take. You can therefore continue to apply for funding from the various funding bodies. However, please check that you are on the Qualiopi certification list. In accordance with article R.6316-5 of the French Labor Codethe certifying bodies and labeling authorities transmit a list to the Ministry of Labor, which is responsible for publishing it on a daily basis. This enables funders to check the validity of a Qualiopi certificate, just like Data dock.
However, beware of CPF eligibility: While Qualiopi certification is necessary to maintain your eligibility, you should also pay attention to the following point:
If you have entered into a partnership with a certification body, you need to ensure that its certification is still active in the RS or RNCP. Many certifications expire at the end of 2021, and a number of them have not been renewed.
You also need to be careful about maintaining your certification. You need to remain committed to continuous improvement, and prepare for your surveillance audits.
You have not yet obtained Qualiopi
If you haven’t yet obtained certification, don’t panic! You may still be able to benefit from public and mutualized funds, depending on your situation. However, you need to prepare thoroughly for the initial audit, so as to obtain certification as soon as possible.
You have takeover agreements signed in 2021
If you are not certified, but some funding bodies have agreed to pay for training courses for which the service contract was signed in 2021, then these training courses will still be covered. What matters is the date on which the agreement was signed, not the date on which the training action was carried out. All agreements signed in 2021 will therefore be honored by the funding bodies. On the other hand, all training starting in 2022 will not be reimbursed, unless you qualify for the transitional period.
You have signed a contract with a certification body or a labelling body
If you signed a contract before 12/31/2021 to pass the initial audit, you can continue to benefit from public and mutualized funds even if you have not yet obtained certification. The government has in fact set up a transitional period to facilitate access to funds for organizations that are in the process of acquiring certification. All you need to do is provide the funder with a copy of the Qualiopi certification contract.
You have three months to obtain Qualiopi certification. As of March 31, 2022, if you are still not certified, you will no longer be eligible. A new decree could extend the transitional period to June 30, 2022, but this is not certain, so it’s best to do everything you can to get certified before the end of March.

You have not signed a contract and you do not have a management agreement signed in 2021.
In this case, you unfortunately no longer have access to public and mutualized funds. This means that your customers have to finance their training themselves. They can no longer obtain funding from their OPCO, Pôle Emploi or the CPF.
However, you can still obtain certification if you wish! You’ll need to prepare for the initial audit, sign a contract with a certification body or labeling authority, and obtain an audit date. In order to obtain certification quickly, and thus regain access to public and mutualized funds, we advise you to seek expert assistance.
You are a new apprentice training center (CFA)
If your organization is a newly-created apprentice training center, you have access to specific measures.
In fact, if you provide apprenticeship training for the first time in 2022, you can receive funding for six months, without being Qualiopi certified. This six-month period begins as soon as you sign your first apprenticeship training agreement, or your first apprenticeship contract.
You will, however, have to send the financer a copy of a Qualiopi certification contract within two months. This means that you must make a commitment to a certifying body or labeling body within two months of signing the training agreement, but you then have a further four months to obtain certification.
If you do not submit this document, you will no longer be able to obtain funding for new apprenticeship training courses.
Finally, if you have not yet obtained Qualiopi after six months, you will not be able to sign any new agreements with a funder. However, agreements already signed will continue to be covered.
