It
asserted that French requirements filter rather than obstruct,
and produced not one article of law to show it. On a page whose
entire audience is foreign operators deciding whether to commit
capital in France, that is the wrong way round. The v2 keeps the
thesis, keeps the signature sentences, and puts the law under
them. Visible body roughly doubles.
------------------------------------------------------------
THE FIVE CORRECTIONS RAISED ON REVIEW · ALL APPLIED
1 PLURAL AGREEMENT. "French requirements ... It seeks to
transform" and "its purpose". Both gone with the rewrite.
2 THE CONFORMITY SENTENCE. The v1 wrote "we do not ask foreign
schools to conform to French standards". Read literally, that
says conformity is optional. It is not. Section VI now reads
"we do not merely ask foreign institutions to conform to
French requirements", which is the actual position: the House
does not reduce institutional entry to conformity.
3 THE HOMOGENISED LIST. "The RNCP, RS, Qualiopi frameworks, or
the requirements of the Rectorate" flattened four objects of
different legal natures into one word. Corrected in section I
to "RNCP and Répertoire spécifique registration, Qualiopi
certification, and the requirements applicable before the
competent Rectorate", and each is then given its actual
perimeter.
4 THE SEQUENCE. "Doctrine first, territory second, recognition
last" predates the current doctrine and drops architecture.
Replaced by determination, architecture, execution.
5 THE OFFER NAME. "The Arché International Audit" is a retired
designation and "audit" reduces a determination to a
verification. Replaced by Arché, the Institutional Entry
Review, with the three verdicts made visible.
------------------------------------------------------------
WHAT THE v2 ADDS · AND WHY IT IS PROPRIETARY
A NATIONALITY. This is the finding. L731-1 opens the free
declaratory regime to a French national, a national of an EU
member State or of an EEA State, aged twenty-five, plus
associations lawfully formed for higher education. L731-8
then subjects everyone else to an AUTHORISATION to open
courses or to DIRECT an establishment, after the opinion of
the academic education council. An article addressed to
foreign operators that never mentions this was missing its
own subject.
B THE AUTHORISATION IS PERSONAL. L731-8 is drafted on persons,
not on establishments. It is intuitu personae. The
consequence is operational and is stated in section II: the
obstacle is structural to the person, not to the project, and
it reappears precisely when a third-country national wants to
direct.
C THE CODE DOES NOT NAME THE DECIDING AUTHORITY. L731-8 is
passive. L234-6 I 2° organises the opinion of the academic
council. No identified text says who signs. The rector is the
coherent hypothesis and is NOT asserted. The page states the
absence, which is itself the finding.
D THE CATEGORY DOES NOT EXIST. A full search of the Education
Code, legislative and regulatory, returns no provision on
foreign establishments awarding their own foreign degrees in
France, and none on delocalised campuses. The words
"délocalisé", "campus" in that sense, "établissement
étranger" as a governed category: absent. Section III turns
that absence into the operative rule. A foreign operator does
not open a foreign campus in France. It opens a French
private higher education establishment.
E RS IS NOT A SMALLER RNCP. L6113-6 registers certifications
for competencies COMPLEMENTARY to professional
certifications. No level of qualification, no place in the
national framework, no grade. "RS certification at level 6"
is a legal impossibility. Section IV.
F COMPARABILITY IS NOT EQUIVALENCE. The comparability statement
of the ENIC-NARIC France centre rests on D314-52 of the
Education Code, which frames it as an establishment act. It
has no legal force and is not compulsory. There is no
automatic equivalence in French law. Section V.
------------------------------------------------------------
⚠ FOUR THINGS THIS PAGE MUST NOT SAY
1 Who signs the L731-8 authorisation. Not established.
2 Anything on the position of Swiss nationals. L731-1 and
L731-8 name the EU and the EEA; Switzerland is party to
neither, but the 1999 free movement agreement was not
verified. Silence.
3 That "bachelor" or "mastère" are prohibited. They are not.
L731-14 protects université, baccalauréat, licence, doctorat
and, conditionally, master. The prohibition of bachelor and
mastère is a RECOMMENDATION of the June 2026 IGAS/IGÉSR
report, and section IV labels it as such.
4 That a manquement to L731-19 is penally sanctioned. L731-9
covers only L731-2 to L731-7. Not verified. Silence.
------------------------------------------------------------
⚠ NO
IN THIS BLOCK. Hierarchy starts at h2. The H1 is
managed and verified through AISEO. The display title is a

styled as a title. Verify the rendered DOM before publishing.
------------------------------------------------------------
IMAGE · caption and alt text, as approved
Caption : Foreign excellence does not enter France unchanged.
Under the Arch, it is translated into a coherent,
defensible institutional architecture.
Alt : An architectural arch opening onto an international
cityscape, symbolising the institutional entry of
foreign educational models into France.
The caption is doctrinal, the alt text descriptive. Its object is the legal capacity of an individual to perform two acts, opening courses and directing establishments. It is not an establishment licence, not an accreditation, not a recognition, not a programme approval. A third-country national who is authorised holds nothing over the establishment itself, which remains subject to the ordinary declaratory regime and to every obligation of the title.

It attaches to direction. L731-8 is the only article in the chapter that names the act of directing. The difficulty is therefore structural to the person, not to the project. It recedes where the establishment is opened by an association lawfully formed for higher education or administered by persons meeting the conditions of L731-1. It returns the moment a third-country national wants to direct in their own name.

The consulted body is academic, not national. The opinion is that of the education council instituted in each académie, which the code still calls in places the conseil académique de l’éducation nationale. Article L234-6, I, 2° confirms the referral expressly. The Cneser has no competence here. The opinion is simple, not binding: where the legislator wanted a binding opinion, as at article L6113-6 of the Labour Code, it wrote one.

One detail deserves to be recorded rather than smoothed over. The code organises the opinion and does not name the authority that signs the authorisation. L731-8 is drafted in the passive. No identified provision, legislative or regulatory, designates the decision maker. For a regime of prior authorisation, that silence is not a curiosity. It is a measure of how rarely the question has been posed.

A separate filter runs alongside, and it applies whatever the nationality of the applicant. Under article L731-1-1, the prefect may oppose the opening of a course or an establishment in order to prevent any form of foreign interference or to protect the fundamental interests of the Nation. This one bears on the project, not the person, and it carries closure of the establishment.

The bill on the regulation of private higher education, adopted by the Senate at first reading on 1 June 2026 and still before the National Assembly, would extend the right to open to any lawfully constituted legal person. It does not touch L731-8. The nationality condition, its 2000 drafting and its academic opinion survive the reform as it stands.

III · The missing category

French law does not know what a foreign establishment is.

Search the Education Code, legislative and regulatory parts, for the establishment that awards its own foreign degree in France. Incapacities under L731-7. Authorisation under L731-8 where a third-country national is involved. Prefectoral opposition under L731-1-1.

And the foreign degree awarded in France has no French legal existence. It is not a national diploma, not a State-endorsed diploma, not a grade. University, baccalauréat, licence and doctorat are prohibited outright. The name of master, and any reference to the master’s grade, are prohibited only in the absence of accreditation or authorisation by the State. The same fine applies in all three cases.

Note what the article does not prohibit. The commercial names most used by the private sector are not listed. The June 2026 joint report of the IGAS and the IGÉSR recommends adding them, proposing to prohibit terms liable to create confusion in course titles, naming bachelor and mastère, and to require an explicit statement that the certification is equivalent to none of the national degrees and opens no automatic right to continue at university. That is a recommendation, not law. It is also a reliable indication of where the line is moving.

Alongside the prohibition sits a positive obligation. Article L731-19 requires private higher education establishments to state, in their advertising, their status and the nature of their relations with the State. Two cumulative elements, in the present indicative, which is to say imperative.

And a registration that carries no level

One confusion costs more than the others. Article L6113-6 establishes the Répertoire spécifique, which registers certifications and accreditations corresponding to professional competencies complementary to professional certifications. Complementary is the operative word.

The RNCP classifies its certifications by level of qualification within the national framework, in blocks of competencies, with possible correspondences with the certifications of European Union States. The Répertoire spécifique does none of that. No level. No place in the framework. No grade. Presenting a Répertoire spécifique certification as a State-recognised qualification at level 6 or 7 is not an exaggeration. It has no legal force. It is not compulsory. The final decision belongs to the receiving institution.

The reason sits one level higher. Article L613-1 opens with a sentence that admits no alternative reading: “The State holds the monopoly on the conferral of degrees and university titles.” Where the State holds a monopoly, no third party issues an equivalent.

The word equivalence does survive in one place, and it is a trap. Article D714-8 charges the university service for foreign students with verifying whether foreign degrees may be granted equivalence with a view to the studies envisaged. That is an internal appraisal, specific to one institution, one faculty, one course. The same degree may be admitted in one and refused in another. Which is the definition of having no equivalence.

The framework is not purely national. Under the Lisbon Recognition Convention of 11 April 1997, published in France by decree n° 2000-941, each Party recognises the higher education qualifications conferred in another Party unless a substantial difference can be shown.
