The sentence\n        is not traceable to any France competences publication. A\n        House that sells institutional reading cannot attribute an\n        editorial reformulation to a public body. Removed, not\n        rephrased. Nothing replaces it but sourced law.\n        Note also: the body is written \"France competences\", lower\n        case c. The v1 capitalised it. And in August 2026 the\n        \"latest\" report is the 2025 one, not the 2024 one.\n     2  QUALIOPI \/ RNCP \/ EESPIG ARE NO LONGER PRESENTED AS THREE\n        COMPARABLE REFORMS. They sit in two different codes, examine\n        three different objects, and are granted by three different\n        authorities. Section II now states the taxonomy with the\n        governing articles. This is the section that turns a good\n        essay into a proprietary reading.\n        \u00b7 RNCP registers a CERTIFICATION (C. trav., L6113-1). Never\n          an institution. \"RNCP school\" has no legal existence.\n        \u00b7 Qualiopi certifies a PROVIDER, and only where one of seven\n          listed funders pays (C. trav., L6316-1). It is a condition\n          of access to public money, not a general quality duty.\n        \u00b7 EESPIG qualifies an ESTABLISHMENT and is structurally\n          closed to for-profit operators (C. educ., L732-1 al. 2 and\n          L732-2). The v1 invited the whole audience to look into a\n          mirror most of it can never enter.\n     3  \"RECTORATE APPROVAL\" IS REMOVED. There is nothing to approve.\n        Opening is a declaration with a receipt (L731-3). The recteur\n        opposes nothing, unless the establishment is technical, in\n        which case L731-17 switches the whole regime to L441-1.\n        That switch is now section IV. Nobody else writes it.\n     4  THE TIGHTENING IS NOW DATED AND SOURCED. The v1 asserted that\n        criteria had been tightened, with no instrument named. Three\n        decrees carry it: n\u00b0 2025-500 of 6 June 2025, n\u00b0 2025-800 of\n        12 August 2025, n\u00b0 2026-728 of 1 August 2026. Section III.\n     5  THE BILL IS NAMED AS A BILL. The v1 implied a 2026 state of\n        law that does not exist at establishment level. Bill n\u00b0 313\n        was adopted by the Senate at first reading on 1 June 2026\n        and has not moved since. Not promulgated. Section V turns\n        that fact into the doctrinal position: settled at\n        certification level, pending at establishment level, and\n        exposure builds in the gap.\n     6  FOUR REPEATED MOVEMENTS DELETED. \"Era of Suspicion\", \"Age of\n        Discernment\", \"Return of Meaning\" and \"Acid Test, Revealing\n        Maturity\" restated one thesis four times. Roughly 20 per\n        cent removed. Nothing of the argument is lost.\n     7  THE NORMATIVE PASSAGE ON FRANCE IS REBUILT ON FACT.\n        \"France resists\" and \"France does not impose standards to\n        hinder, but to protect\" attributed a unified intention to a\n        whole system. Replaced by two verifiable asymmetries: the\n        State monopoly on the collation of grades (C. educ., L613-1)\n        and the closure of EESPIG to for-profit operators. Same\n        height, defensible before a lawyer.\n     8  PRIMARY SOURCES BLOCK ADDED. E-E-A-T. Every article cited in\n        the body is linked in context and listed at the foot.\n     ------------------------------------------------------------\n     WHAT IS DELIBERATELY KEPT FROM THE v1\n     \"Recognition is no longer a status. No\n        change since. Three findings now carried in the page:\n        \u00b7 the offence is committed by \"le responsable d'un\n          \u00e9tablissement\", a natural person, not by the establishment;\n        \u00b7 30 000 euros, the same fine in all three cases, fine only;\n        \u00b7 the regimes are NOT symmetrical. University, baccalaur\u00e9at,\n          licence and doctorat are absolute prohibitions. Master is\n          prohibited only \"sans avoir \u00e9t\u00e9 accr\u00e9dit\u00e9 ou autoris\u00e9 par\n          l'Etat, dans l'un ou l'autre cas\", the incise attaching the\n          condition to both limbs of the third paragraph.\n        AND the point worth publishing: L731-17 sets aside\n        L731-1 to L731-13, L731-15 and L731-16. It does NOT set\n        aside L731-14. The enumeration breaks its sequence at 13 and\n        resumes at 15. The DILA citation links of L731-17 confirm it:\n        L731-14 is absent from them. The title prohibition therefore\n        applies to technical establishments too, that is to the bulk\n        of the for-profit sector. Reading a contrario, stated in the\n        page as what the text says, with no claim of case law.\n     F  L471-3 ADDED. It is the rector's only real upstream power\n        over a private higher education establishment: prior filing\n        of all advertising, fifteen days, referral to the consumer\n        protection authority for anything that appears to breach\n        L731-14. It sharpens section IV: what the rector examines\n        first is the claim, not the project. Cited without a link,\n        the article ID not having been verified.\n     G  CONCLUSION. The closing enumeration was more general than\n        the four sections preceding it. Labels have industrialised. A number of operators concluded that compliance would establish a brand.<\/p>\n      <p>An educational brand is not a sum of documents. It is a promise kept, and a structure capable of keeping it.<\/p>\n      <p>The distinction is not rhetorical. It determines what survives an examination. Prestige no longer suffices, proof is required. Marketing no longer compensates, consistency is required. Discourse no longer reassures, governance is required.<\/p>\n      <p>Public funders, OPCOs, rectorates and learners are looking for one thing. Reliability. It cannot be decreed. It is demonstrated, or it is not.<\/p>\n      <p>What follows is the architecture against which that demonstration is read. It is routinely described as one movement. Three regimes, not three mirrors.<\/h2>\n    <div class=\"body-text\">\n      <p>They are presented as three faces of a single tightening. They are not. They sit in two different codes, examine three different objects, and are granted by three different authorities. Confusing them is the most common error in the sector, and the most expensive.<\/p>\n\n      <div class=\"dim-grid\">\n        <div class=\"dim-item\">\n          <p class=\"dim-num\">Regime 1 \u00b7 Labour Code<\/p>\n          <p class=\"dim-title\">RNCP registers a certification. Never an institution.<\/p>\n          <p class=\"dim-body\"><a class=\"inl\" href=\"https:\/\/code.travail.gouv.fr\/code-du-travail\/l6113-1\">Article L6113-1<\/a> of the French Labour Code registers <strong>professional certifications<\/strong>, each defined by three reference frameworks: activities, competencies, assessment. <a class=\"inl\" href=\"https:\/\/code.travail.gouv.fr\/code-du-travail\/l6113-5\">Article L6113-5<\/a> registers diplomas, titles and professional qualification certificates, for a maximum of five years, on application by the ministries and certifying bodies that created them.<\/p>\n          <p class=\"dim-body\">The institution is never the object of the registration. It is either the certifying body that created the certification, or a third party <strong>habilitated<\/strong> by that body under article R6113-16. The expression &#8220;RNCP school&#8221; has no legal meaning. What exists is a registered certification, and an organisation authorised to prepare for it or to award it.<\/p>\n        <\/div>\n        <div class=\"dim-item\">\n          <p class=\"dim-num\">Regime 2 \u00b7 Labour Code<\/p>\n          <p class=\"dim-title\">Qualiopi certifies a provider, where public or pooled funding is involved.<\/p>\n          <p class=\"dim-body\"><a class=\"inl\" href=\"https:\/\/code.travail.gouv.fr\/code-du-travail\/l6316-1\">Article L6316-1<\/a> applies to providers <em>financed by<\/em> a closed list: skills operators, the professional transition commission, the State, the regions, the Caisse des d\u00e9p\u00f4ts, France Travail, Agefiph. A provider operating outside those financings is not within the scope. It may lawfully train without Qualiopi.<\/p>\n          <p class=\"dim-body\">Qualiopi is therefore <strong>a condition of access to public and pooled funding<\/strong>, not a general duty of quality. <a class=\"inl\" href=\"https:\/\/code.travail.gouv.fr\/code-du-travail\/l6316-2\">Article L6316-2<\/a> opens two routes to it: a certification body accredited, or in the course of being accredited, by the national accreditation body or by any signatory of the European multilateral accreditation agreement, and, alternatively, a labelling body recognised by France comp\u00e9tences. Three years. It says nothing about academic level, nothing about the value of a degree, nothing about the standing of an establishment.<\/p>\n        <\/div>\n        <div class=\"dim-item\">\n          <p class=\"dim-num\">Regime 3 \u00b7 Education Code<\/p>\n          <p class=\"dim-title\">EESPIG qualifies an establishment, and is closed to most of them.<\/p>\n          <p class=\"dim-body\"><a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000029321795\">Article L732-1<\/a> of the Education Code reserves the qualification to non-profit establishments created by associations, foundations recognised as being of public utility, or professional unions. <a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027738718\">Article L732-2<\/a> adds disinterested management within the meaning of the General Tax Code, and binds the qualification to a multi-year contract with the State.<\/p>\n          <p class=\"dim-body\">It is granted <strong>by ministerial order<\/strong>, after the opinion of the advisory committee for private higher education, for the duration of that contract: one to five years, renewable for five after evaluation by the Hc\u00e9res. A commercial company will never obtain it, whatever its performance. This is the single most discriminating fact of the three, and the one an international operator should read first.<\/p>\n        <\/div>\n      <\/div>\n\n      <p class=\"pivot\">They coexist on one structure.<br><strong>None substitutes for another. None is a higher degree of another.<\/strong><\/p>\n    <\/div>\n  <\/div>\n\n  <!-- \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 III \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 -->\n  <div class=\"block fd f4\">\n    <p class=\"block-num\">III \u00b7 The evidence<\/p>\n    <h2>The tightening is real. It is also dated.<\/h2>\n    <div class=\"body-text\">\n      <p>The claim that criteria have hardened circulates widely and is rarely sourced. It should be. Three instruments carry it, in fourteen months.<\/p>\n\n      <div class=\"tl\">\n        <div class=\"tl-row\">\n          <p class=\"tl-date\">6 June 2025<\/p>\n          <p class=\"tl-body\"><a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000051700314\"><strong>Decree n\u00b0 2025-500<\/strong><\/a> rewrites twenty-four articles of the Labour Code, applicable to applications filed from 1 October 2025. Two new criteria appear at <a class=\"inl\" href=\"https:\/\/code.travail.gouv.fr\/code-du-travail\/r6113-9\">article R6113-9<\/a>: verification of the <strong>reality<\/strong> of the technical, teaching and supervisory resources actually deployed, and their consistency with the declared reference frameworks. Not the submission. What stands behind it. The same text conditions registration on the good standing of directors, assessed at any point during the registration period, allows precautionary suspension, opens a power of documentary control, and caps registration at three years where a single year of data supports the application.<\/p>\n        <\/div>\n        <div class=\"tl-row\">\n          <p class=\"tl-date\">12 August 2025<\/p>\n          <p class=\"tl-body\"><strong>Decree n\u00b0 2025-800<\/strong> extends the same logic to State diplomas, which now pass through explicit criteria and a prior examination by France comp\u00e9tences before the consultative commissions give their opinion. The route of right is narrowed too.<\/p>\n        <\/div>\n        <div class=\"tl-row\">\n          <p class=\"tl-date\">1 August 2026<\/p>\n          <p class=\"tl-body\"><a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000054608509\"><strong>Decree n\u00b0 2026-728<\/strong><\/a>, published on 4 August 2026, replaces the national quality reference framework with a new set of thirty-three indicators under the same seven criteria. Its article 2 reads in full: <em>&#8220;This decree enters into force on 1 November 2026.&#8221;<\/em> It carries <strong>no transitional provision<\/strong>. Nothing on certificates already held, nothing on audits already commissioned. Providers certified under the current framework will be audited against another one, and the terms of that passage are not in the decree.<\/p>\n        <\/div>\n      <\/div>\n\n      <p>Read as a sequence, the direction is not ambiguous. The examination has moved from the file to the execution. An institution that has built its position on the quality of its submissions has built on the part that is no longer decisive.<\/p>\n    <\/div>\n  <\/div>\n\n  <!-- \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 IV \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 -->\n  <div class=\"block fd f4\">\n    <p class=\"block-num\">IV \u00b7 The blind spot<\/p>\n    <h2>Opening an institution in France is a declaration. Until it is not.<\/h2>\n    <div class=\"body-text\">\n      <p>This is the level almost nobody reads before signing a lease, and the one where exposure accumulates fastest.<\/p>\n\n      <div class=\"statute\">\n        <p class=\"statute-ref\">Education Code \u00b7 Article L731-3<\/p>\n        <p class=\"statute-text\">&#8220;A receipt is issued immediately. The course may not open until ten clear days after the receipt has been issued.&#8221;<\/p>\n        <p class=\"statute-gloss\">Declaration to the regional academic rector. Receipt issued as of right. Opening ten days later.<\/p>\n      <\/div>\n\n      <p>There is no approval. The rector inspects the premises and informs the public prosecutor. The power to oppose belongs to the <strong>prosecutor<\/strong>, within ten days, on two grounds only: a teacher subject to an incapacity, or a subject contrary to public order (article L731-11). It also belongs to the <strong>prefect<\/strong>, to prevent foreign interference (article L731-1-1). It does not belong to the rector.<\/p>\n\n      <p>The rector holds one real power upstream, and it is not the one operators expect. Under article L471-3 of the Education Code, all advertising by any teaching establishment must be filed with the rector beforehand and may not run for fifteen days. Within that window the rector refers to the consumer protection authority any advertising that appears to breach article L731-14. What the rector examines first is therefore not the project. It is the claim the project makes about itself.<\/p>\n\n      <p>Then comes the switch. <a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036802283\">Article L731-17<\/a> removes that entire chapter for <strong>private technical higher education establishments<\/strong> and applies article L441-1 instead. Three months rather than ten days. Four authorities empowered to oppose, <strong>including the rector<\/strong>, on four grounds, one of which is that the project does not have the character of an educational establishment.<\/p>\n\n      <p>Ten days or three months. No rectoral opposition or full rectoral opposition. The difference rests on a qualification most operators never establish before committing capital.<\/p>\n\n      <h3>And none of this confers recognition<\/h3>\n      <p>Opening is not recognition, and the two are settled by different authorities. The collation of grades and university titles is a <strong>State monopoly<\/strong> under <a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000046774857\">article L613-1<\/a>. Recognition of a technical establishment is granted by the minister under article L443-2. The EESPIG qualification is granted by the minister under article L732-1. Never by the rector.<\/p>\n      <p><a class=\"inl\" href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000027748361\">Article L731-14<\/a> completes the picture with a penalty rather than a permission. A private establishment may in no case take the title of university, and the certificates it awards may not bear the titles of baccalaur\u00e9at, licence or doctorat. Those two prohibitions are absolute. Awarding a degree bearing the name of master, or referring to the master&#8217;s grade, is prohibited only in the absence of State accreditation or authorisation. The offence is committed by <strong>the person responsible for the establishment<\/strong>, and carries a fine of thirty thousand euros in each of the three cases.<\/p>\n      <p>One detail decides who this concerns. Article L731-17 sets aside articles L731-1 to L731-13, L731-15 and L731-16 for technical establishments. <strong>It does not set aside L731-14.<\/strong> The enumeration breaks its own sequence at thirteen and resumes at fifteen. The prohibition on titles, and the fine attached to it, therefore follow the business schools, engineering schools and consular schools that make up the greater part of the for-profit sector. They are the operators most likely to build a commercial name on a word the law reserves.<\/p>\n      <p class=\"pivot\">Confusing the right to open<br><strong>with the right to be recognised<\/strong><br>is the structuring error of the sector.<\/p>\n    <\/div>\n  <\/div>\n\n  <!-- \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 V \u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550\u2550 -->\n  <div class=\"block fd f5\">\n    <p class=\"block-num\">V \u00b7 The pending<\/p>\n    <h2>The most cited reform is not in force.<\/h2>\n    <div class=\"body-text\">\n      <p>A bill on the regulation of private higher education was <a class=\"inl\" href=\"https:\/\/www.senat.fr\/dossier-legislatif\/pjl25-313.html\">adopted by the Senate at first reading on 1 June 2026<\/a> and transmitted to the National Assembly on 2 June. It has not moved since. It is not promulgated. Every statement in the preceding sections describes the law as it stands.<\/p>\n      <p>What the text would change, if it passes, is structural. A single two-month period replacing both the ten days and the three months. The academic authority becoming a full opposition authority, on six grounds, including whether the teaching proposed has the character of higher education. Two new ministerial approvals granted after Hc\u00e9res evaluation: one for quality, <strong>open to for-profit operators<\/strong>, one of public interest reserved to the non-profit sector. Access to Parcoursup, to scholarship students and to national diplomas conditioned on holding one of them. One year for existing establishments to comply.<\/p>\n      <p>Read the two levels together and the position becomes legible. The tightening is <strong>settled<\/strong> on certifications, by decree, already in force.
