A structure that thinks itself in procedure.<\/h3>\n    <div class=\"body-text\">\n      <p>The observed structure is a French private higher education institution, in activity for several years, having submitted to the Rectorate of its reference academy a request for complementary recognition. The file was submitted at the beginning of an academic year. Management has considered it, since then, as a procedure under way. It is waiting for the response. <em>This wait is, in itself, a signal.<\/em><\/p>\n      <p>Several months have passed. No request for additional documents has been made. No examination date has been communicated. Silence is interpreted by management as a positive sign. <strong>It is read, in reality, as a prolonged period of observation.<\/strong><\/p>\n      <p>During the same period, the structure has engaged two structuring public decisions. It has announced the opening of a new programme cycle for the following academic year. It has recruited a cohort on the basis of that announcement. Both decisions were taken assuming that the procedure would conclude favourably before the start of the academic year. <em>Neither assumes it legally.<\/em><\/p>\n      <p>The reading was conducted at the request of the President, on the occasion of a Board of Directors meeting where the question was raised: <em>should we communicate the opening of the cycle, or should we wait for the formal response of the authority?<\/em><\/p>\n    <\/div>\n  <\/div>\n\n  <!-- BLOCK 5 . Certain attestations predate governance evolutions that the structure has not reported to the authority. The file reflects a reality that is no longer that of the structure at the moment it is reviewed.\n          <span class=\"signal-anchor\">In rectoral review practice, an aged file is reviewed as submitted, without automatic update by the authority.<\/span>\n        <\/div>\n        <div class=\"signal-item\">\n          <span class=\"signal-num\">SIGNAL 02<\/span>\n          <strong>Public communication anticipating recognition.<\/strong> Commercial materials, admission sheets, and communication to families present the cycle as recognised. Recognition is in reality conditional on the Rectorate&#8217;s decision. The structure has committed its public word to a condition that has not been fulfilled.\n          <span class=\"signal-anchor\">Under a DGESIP reading cross-referenced with rectoral review, this anticipation constitutes an explicit signal of procedural posture fragility.<\/span>\n        <\/div>\n        <div class=\"signal-item\">\n          <span class=\"signal-num\">SIGNAL 03<\/span>\n          <strong>Absence of incoming communication from the Rectorate for more than six months.<\/strong> No request for additional documents. No document request. No examination date. The structure interprets this silence as an absence of objection. The authority uses it, as a rule, as a time for consolidating its own reading of the file, independently of any interaction with the structure.\n          <span class=\"signal-anchor\">In the in-depth review regime, procedural silence is a time of reading, never a time of agreement.<\/span>\n        <\/div>\n        <div class=\"signal-item\">\n          <span class=\"signal-num\">SIGNAL 04<\/span>\n          <strong>Recruitment of a cohort on the basis of the procedure under way.<\/strong> Families have engaged a course of study, contracts have been signed, deposits have been paid. The structure has transformed a procedure into a contractual commitment with third parties. If the final decision is unfavourable or conditional, these commitments become immediately a factor of public exposure.\n          <span class=\"signal-anchor\">Under a consumer protection reading cross-referenced with the requirement of fair information, this contractual anticipation amplifies the legal exposure of the structure.<\/span>\n        <\/div>\n      <\/div>\n      <p>Taken together, these four signals indicate that the structure has built a public reality upstream of institutional arbitration. <em>This public reality will become tenable if the decision is favourable. It will become unsustainable if it is not.<\/em> The Rectorate reviews one of the two scenarios. It arbitrates the coherence between the declared file and the readable structure. Four dimensions were applied to the reading of this structure.<\/p>\n      <div class=\"reading-grid\">\n        <div class=\"reading-item\">\n          <p class=\"reading-num\">Dimension 1<\/p>\n          <p class=\"reading-title\">Coherence of the file over time<\/p>\n          <p class=\"reading-body\">The system observes the gap between the documents submitted and the current reality of the structure. A dated attestation commits the structure only if it remains accurate at the time of review. On the observed structure, several documents no longer reflect the current situation. The submitted file becomes, month after month, an aged file.<\/p>\n        <\/div>\n        <div class=\"reading-item\">\n          <p class=\"reading-num\">Dimension 2<\/p>\n          <p class=\"reading-title\">Coherence between submitted file and public communication<\/p>\n          <p class=\"reading-body\">The system compares the reviewed file with the public materials produced by the structure during the review. Any divergence becomes an unfavourable signal. On the observed structure, public communication presents as acquired what the file presents as requested. This divergence is identifiable and tracked.<\/p>\n        <\/div>\n        <div class=\"reading-item\">\n          <p class=\"reading-num\">Dimension 3<\/p>\n          <p class=\"reading-title\">Procedural posture<\/p>\n          <p class=\"reading-body\">The system distinguishes structures that submit a consolidated file from those that submit a file to open the procedure and complete it afterwards. The distinction does not appear in the texts. It is read in the details. On the observed structure, several elements suggest an incomplete submission: missing documents not reported, conditional formulations, references to upcoming decisions as if they were acquired.<\/p>\n        <\/div>\n        <div class=\"reading-item\">\n          <p class=\"reading-num\">Dimension 4<\/p>\n          <p class=\"reading-title\">Capacity to absorb a partial refusal<\/p>\n          <p class=\"reading-body\">The system anticipates the consequences of a conditional or unfavourable decision. If recognition is granted under conditions, can the structure adjust its communication, its admission procedure, its contractual commitments? On the observed structure, room for manoeuvre is limited.
