Institutional reading · establishment in France
Ten months separate decision-makers from September 2027. For an institution preparing to open a higher education establishment in France at that intake, November and December 2026 are not a waiting period. They are the period in which the order of arbitrations on which the trajectory will depend is settled.
A schedule that does not start where you think
A director preparing the opening of a private higher education institution in France often works back from the administrative deadline of Article L.441-1 of the French Code of Education: three months before opening. For September 2027, that would mean filing in June.
This reading confuses the legal declaration schedule with the real schedule of an institutional entry. The first is an administrative delay. The second is an architecture. The two do not run on the same timings.
Between November 2026 and September 2027, an institution opening an establishment in France must have arbitrated several decisions of a legal, academic, real-estate and institutional nature, in an order that conditions their legibility before the competent authorities. Most of these arbitrations must be made before the premises are visited, before teachers are recruited, before the first partnership agreement is signed.
The L.441-1 declaration is not an authorisation
Article L.731-17 of the French Code of Education subjects private technical higher education institutions to the declaration regime of Articles L.441-1 to L.441-4. This regime is not an administrative authorisation: it combines a prior declaration with a power of opposition reserved to certain authorities.
Legal summary · French Code of Education
Single declaration to four authorities. The file is addressed to the rector of the academic region, the mayor of the municipality of establishment, the prefect and the public prosecutor. Each of these authorities holds a power of opposition under the conditions provided for by law.
Completeness check then three-month delay. The instructing service has an indicative period of fifteen days to acknowledge the completeness of the file. The three-month period before opening only runs from this acknowledgement.
Verified on 31 October 2026 against the texts in force on Légifrance. For the full texts, refer to Légifrance. In the absence of opposition, and subject to the other applicable obligations, opening may take place at the end of the delay. This distinction governs the director’s posture: they are not requesting an authorisation, they are preparing a file whose coherence will be examined by the four competent authorities.
A declaration filed without prior resolution of the structuring questions exposes the project to requests for clarification, to difficulties in instruction, or, where the legal conditions are met, to an opposition.
A director preparing an opening in France quickly encounters two neighbouring but distinct expressions. Private higher education designates in a broad sense the institutions created by private persons outside the public university service. Private technical higher education designates, more precisely, a category of institutions falling under Title III of Book VII of the Code of Education, with a professional and technical vocation. This distinction is not semantic. It carries consequences on the applicable regime, the competent authority and the declaration procedures.
What is exposed before being examined becomes harder to reconfigure without consequence.
Six interdependent domains of decision
For a September 2027 opening, here are the six domains whose arbitrations interlock before any public exposure, any irreversible commitment and any contact with an authority. They do not form a linear sequence. They form a system of interdependencies.
Legal status of the institution
Who carries the award before the French authority? Foreign legal entity directly, French subsidiary, association, SASU: institutional legibility differs.
Regime of the institution
Private technical higher education under L.731-17, or another applicable regime? The same programme can fall under different regimes depending on the legal entity.
Positioning of the award delivered
National diploma, qualification registered in the RNCP, certification in the RS, own award, double degree: each positioning engages distinct procedures and deadlines.
Designation of the director
Conditions of Article L.914-3 with L.731-17 adjustments: professional qualification, five years of exercise, minimum age (R.913-16), good standing (L.911-5).
Premises and ERP regime
Safety commission, accessibility, operating authorisation. The lease must be conditional on compliance, not the reverse.
Partnerships and agreements
Who commits, who guarantees, who signs on behalf of what? The host country’s authority reads a question the commercial agreement does not settle.
What the House reads
A foreign institution does not durably establish itself in France through the sole conformity of its file. It must establish who carries its academic responsibility, under which governance it operates and how its presence inscribes itself in the French institutional order.
A foreign accreditation, a university recognition in the country of origin or an established international presence do not dispense with determining the regime applicable to the activity envisaged in France.
Arché, the preliminary reading
The six domains above interlock by dependencies. A choice of status conditions the regime. The regime conditions the award. The award conditions the director’s conditions. And so on. This interlocking is what the House calls an institutional trajectory. It is not a list. It is an architecture.
Before building it, it must be read. The Arché determination is this preliminary reading, when justified and accepted by the House. It issues a signed written verdict: GO if the trajectory is defensible, NOT YET if the architecture must be built before any progression, NO GO if the trajectory is not defensible in the configuration examined.
The Arché determination constitutes neither an administrative authorisation nor an assurance of absence of opposition. It establishes a preliminary institutional reading of the project, ready to be laid before a board, transmitted to an investor or presented to an authority.
Arché does not validate projects. It determines whether they can enter.
The deliverable and what may follow
The Arché deliverable is a written document signed by the Founder, prepared for board-level consideration. It contains the configuration examined, the exposure points identified, the reasoned verdict, the decisions to maintain or defer, the conditions to establish and the sequencing of what follows.
At €3,000 excl. VAT, Arché compensates an independent reading conducted before irreversible commitments multiply. Measured against the real envelope of an opening (commercial lease, ERP compliance works, team recruitment, declaration file), this preliminary reading precedes and orients commitments of an order of magnitude greater.
An Arché verdict opens no Mandate automatically. When the trajectory is defensible, the House may authorise, by a separate decision, an Institutional Architecture (construction of the master file), an Execution (effective carrying of the acts), a Regulatory Continuity (maintenance after opening) or an Institutional Arbitration (sovereign decision, reserved access).
September 2027 openings
September 2027: is your trajectory institutionally defensible?
November and December 2026 are the relevant period to submit your configuration to the preliminary examination. A signed written verdict, GO, NOT YET or NO GO, to be laid before a board before commitments become irreversible.
Enter under the ArchSeptember 2027 is not played in September. It is played now, in the order of decisions to be taken and in the legibility of their interlocking. Three administrative months will be visible. The other seven months will decide what those three months reveal.
Legal reading verified on 31 October 2026 against the texts in force on Légifrance and the administrative pages of the competent authorities. This article is intended to be updated in the first quarter of 2027. It does not constitute legal advice. Decisions relating to the conditions for opening a higher education institution in France belong, as the case may be, to the director, their counsel and the competent authorities.
